GDPR Compliance
This document describes how the Fakturuj.si service ensures compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data (hereinafter "GDPR"). This document is intended for service Users and their clients whose personal data are processed through the platform.
1. Data Controller
The controller of the personal data of Fakturuj.si service Users (registration data, payment data, usage data) is:

With respect to the personal data of the User's clients (data on invoices), Elite Digital Services, LLC acts as a Processor within the meaning of Article 28 of the GDPR. The controller of this data is the User themselves.
Data is stored on third-party cloud infrastructure (primarily DigitalOcean). The Provider does not own its own data centres. The location of the infrastructure may change depending on operational needs.
2. EU Representative (Article 27 GDPR)
As Elite Digital Services, LLC does not have its registered office in the European Union, it has appointed the following EU representative in accordance with Article 27 of the GDPR:

Euro business company Kft. serves exclusively as a contact point for GDPR matters in the European Union pursuant to Article 27 of the GDPR. The EU representative does not carry out any commercial activity on behalf of the Provider, does not accept payments, does not enter into contracts and does not create a Permanent Establishment of the Provider in the EU for tax or any other purposes.
3. Role and Responsibilities of the EU Representative
The EU representative performs the following functions in accordance with Article 27 of the GDPR:
- Contact point for data subjects: Data subjects (service Users and their clients) may contact the representative regarding all matters relating to the processing of their personal data and the exercise of their rights under the GDPR.
- Contact point for supervisory authorities: EU supervisory authorities may communicate with the representative regarding all matters relating to the processing of personal data by the controller.
- Receiving GDPR communications: The representative is authorised to receive all GDPR-related communications on behalf of the controller, including requests from data subjects, notifications from supervisory authorities and complaints.
- Record-keeping: The representative maintains records of processing activities in accordance with Article 30 of the GDPR, which are available to supervisory authorities upon request.
4. Supervisory Authorities
Data subjects have the right to lodge a complaint with the supervisory authority in the country of their habitual residence. Below we provide the contact details of the supervisory authorities in the main countries of service operation:

5. User's Obligations
The Fakturuj.si service User, as the controller of their clients' personal data, is obliged to ensure compliance with the GDPR, in particular:
- Cookie consent: If the User integrates features of the Fakturuj.si service on their website, they are obliged to ensure proper cookie consent in accordance with the ePrivacy Directive.
- Information obligation (Art. 13 and 14 GDPR): The User is obliged to inform their clients about the processing of their personal data through the Fakturuj.si service, including the identity of the processor and the purposes of processing.
- Records of processing activities (Art. 30 GDPR): The User is obliged to maintain records of processing activities in which the Fakturuj.si service is also listed as a processor.
- Data Protection Impact Assessment - DPIA (Art. 35 GDPR): Where required, the User is obliged to carry out a data protection impact assessment. The Provider will provide the necessary assistance in this regard.
- Notification of personal data breaches: The User is obliged to notify a personal data breach to the competent supervisory authority within 72 hours and to the Provider within 24 hours of becoming aware, if the breach concerns data processed through the service.
- Data Protection Officer - DPO (Art. 37 GDPR): If the User is required to appoint a Data Protection Officer (DPO), they are obliged to do so and to inform the Provider of the DPO's contact details.
6. Jurisdiction for EU Users
The following jurisdictional provisions apply to Users from the European Union:
- Procedural contact: Euro business company Kft., Rómer Flóris utca 8/B. 3.em., 1024 Budapest, Hungary - serves as the contact point for all GDPR matters.
- Competent court: Under Article 79 of the GDPR, you have the right to bring proceedings before a court in the Member State of your habitual residence or in the place of the alleged infringement.
- Data subjects always have the right to lodge a complaint with the supervisory authority in the country of their habitual residence pursuant to Article 77 of the GDPR.
7. Relationship to Other Legal Documents
This document supplements and should be read in conjunction with the following Fakturuj.si service documents:
- Terms and Conditions (T&C): The main contractual terms and conditions for using the service.
- Privacy Policy: Detailed information about the processing of personal data, legal basis, retention period and the rights of data subjects.
- Data Processing Agreement (DPA): Agreement under Article 28 of the GDPR governing the relationship between the User (controller) and the Provider (processor).
- Cookie Policy: Information about the use of cookies and similar technologies.
In the event of a conflict between this document and the Terms and Conditions, in matters of personal data protection, the provisions of this document and the relevant provisions of the GDPR shall prevail.

9. Governing Law
This document is governed by the laws of the State of Delaware, USA, and forms an inseparable part of the Terms and Conditions. In matters of personal data protection, only the mandatory provisions of Regulation (EU) 2016/679 (GDPR) apply to the extent that they are directly applicable.
